After the appropriate documentation is finalized, we assist clients through the federal trademark assignment recordation process:

  • The signed assignment agreement should be recorded with the appropriate trademark office. The United States Patent and Trademark Office requires a cover sheet meeting the criteria of 37 C.F.R. § 3.31, including names of assignor and assignee, citizenship or state of organization, date of execution, description of interest conveyed, and identification of application or registration numbers; the cover sheet and supporting documents may be submitted electronically or by mail, depending on the filing method.
  • Electronic filing via the USPTO's Assignment Center is preferred, resulting in faster processing. You will receive a notice of recordation within seven days when filing electronically. Paper filings may take up to 20 days.
  • The USPTO charges a fee for recording trademark assignments, typically $40 for the first mark per document (service code 8521), with each additional mark at $25 (service code 8522). Clients must pay the applicable recordation fee for processing. Expedited service is available at $160.
  • Errors in the assignment cover sheet can lead to denial of recordation. Common reasons for non-recordation include missing or mismatching information, illegible documents, missing signatures, or omission of necessary data.
